Damage & Liability Policy
Damage Waiver
By renting equipment from Rent And Roll LLC, the customer agrees to accept responsibility for all rented items from the time of delivery or pickup until the equipment is returned or collected.
Customer Responsibility
The customer is responsible for keeping all rental equipment safe, secure, and protected from damage, theft, loss, misuse, or improper handling during the rental period.
The customer agrees to use all rental equipment only for its intended purpose and to follow any setup, operating, safety, or care instructions provided by Rent And Roll LLC.
Damage Waiver Fee
If a Damage Waiver Fee is included with the rental, the fee may provide limited protection against certain accidental damage that occurs during normal and proper use of the equipment.
The Damage Waiver is not insurance and does not eliminate the customer's responsibility for the rented equipment.
What the Damage Waiver May Cover
Subject to inspection and approval by Rent And Roll LLC, the Damage Waiver may cover accidental damage resulting from normal use, such as minor accidental damage to rental equipment, accidental tears, breaks, or damage not caused by misuse, and certain repairable damage occurring during the rental period.
Coverage is determined by Rent And Roll LLC after the equipment has been returned and inspected.
What Is Not Covered
The Damage Waiver does not cover:
- Theft, disappearance, or loss of equipment
- Intentional damage or vandalism
- Negligence, abuse, or misuse
- Damage caused by exceeding weight or occupancy limits
- Damage caused by improper setup, moving, dismantling, or modification by the customer
- Damage caused by pets, animals, smoking, fire, fireworks, weapons, or hazardous materials
- Damage caused by paint, markers, tape, glue, silly string, confetti, chemicals, food, drinks, or other substances that permanently stain or damage equipment
- Damage caused by failure to protect equipment from rain, wind, flooding, sprinklers, severe weather, or other environmental conditions
- Damage occurring because safety instructions were ignored
- Missing accessories, parts, cords, stakes, sandbags, linens, or other rental items
- Cleaning charges resulting from excessive dirt, food, trash, bodily fluids, grease, wax, or other excessive cleaning requirements
- Damage to equipment that has been moved from the approved rental location without permission
Lost, Stolen, or Destroyed Equipment
If rental equipment is lost, stolen, intentionally damaged, or damaged beyond repair, the customer may be responsible for the full replacement cost of the equipment, including applicable shipping, labor, and replacement expenses.
Inspection and Charges
All rental equipment may be inspected after pickup or return. If damage, missing items, excessive cleaning, or other charges are discovered, the customer authorizes Rent And Roll LLC to charge the payment method on file for amounts owed under the rental agreement, subject to applicable law.
Photos or other documentation may be used to document the condition of rental equipment before and after the rental.
Weather-Related Damage
The customer is responsible for following all weather-related instructions provided by Rent And Roll LLC. Inflatables, tents, canopies, backdrops, decorations, electrical equipment, and other weather-sensitive items must not be used during unsafe weather conditions.
The customer may be responsible for damage caused by failure to secure, shut down, or protect rental equipment when weather conditions become unsafe.
Damage, Cleaning, and Replacement Responsibility
Customers are responsible for damaged, missing, heavily soiled, or misused rental items.
Cleaning or replacement fees may apply when items are returned with wax, food, stains, moisture, or debris beyond normal use.
Liability Waiver and Assumption of Risk
By renting, using, entering, participating in, or being present around rental equipment provided by Rent And Roll LLC, the customer acknowledges and agrees that certain rental equipment and activities may involve inherent risks of injury, property damage, illness, or other harm.
The customer accepts responsibility for the proper supervision, use, and operation of all rented equipment during the rental period.
Assumption of Risk
The customer understands that the use of rental equipment may involve risks including, but not limited to:
- Slips, trips, and falls
- Collisions with people, equipment, structures, or surrounding objects
- Injuries caused by improper use or failure to follow safety instructions
- Injuries involving inflatable attractions, bounce houses, slides, obstacle courses, tents, tables, chairs, concession equipment, photo booths, electrical equipment, and other rental items
- Weather-related hazards including wind, rain, heat, lightning, and unstable ground conditions
- Electrical hazards
- Burns or injuries involving concession or heated equipment
- Injuries caused by overcrowding, rough play, horseplay, misuse, or lack of supervision
- Property damage resulting from the placement or use of rental equipment
The customer voluntarily assumes all risks associated with the use, possession, supervision, and operation of the rented equipment, except where prohibited by law.
Adult Supervision
The customer is responsible for providing appropriate adult supervision at all times when rental equipment is being used. Children must not be left unattended around rental equipment.
The customer is responsible for ensuring that all participants follow posted rules, manufacturer instructions, weight limits, age restrictions, occupancy limits, and any safety instructions provided by Rent And Roll LLC.
Proper Use of Equipment
The customer agrees that rental equipment will only be used for its intended purpose. The customer agrees not to allow reckless behavior, horseplay, unsafe use, unauthorized relocation, modification, dismantling, repair, use during unsafe weather conditions, use by individuals who exceed posted restrictions, or use while under the influence of alcohol, illegal drugs, or substances that impair judgment.
If equipment becomes damaged, unstable, unsafe, or begins malfunctioning, use must stop immediately and Rent And Roll LLC must be contacted.
Release of Liability
To the fullest extent permitted by law, the customer agrees to release and hold harmless Rent And Roll LLC, its owners, employees, contractors, agents, affiliates, and representatives from claims arising from injury, death, property damage, or other loss resulting from the customer's or participants' use, misuse, supervision, possession, or operation of rental equipment.
This release does not apply to liability that cannot legally be waived under applicable law.
Customer Responsibility for Guests and Participants
The customer is responsible for communicating all applicable rules and safety requirements to guests, participants, employees, contractors, and any other persons who use or interact with the rental equipment.
The customer acknowledges that Rent And Roll LLC may not be present during the rental period and is relying on the customer to properly supervise the equipment and its users.
Site Conditions
The customer is responsible for providing a safe and suitable setup location and agrees to disclose known hazards including underground utilities, irrigation systems, septic systems, electrical lines, uneven surfaces, low-hanging branches, sprinklers, soft or unstable ground, pools, bodies of water, or other nearby hazards.
The customer may be responsible for injury or damage resulting from unsafe site conditions that were not disclosed to Rent And Roll LLC.
Weather and Emergency Conditions
The customer agrees to immediately stop use of rental equipment if unsafe weather or emergency conditions occur. Inflatables, tents, canopies, electrical equipment, and other weather-sensitive items must not be used when conditions are unsafe.
The customer agrees to follow any shutdown, evacuation, or safety instructions provided by Rent And Roll LLC.
Indemnification
To the fullest extent permitted by law, the customer agrees to indemnify and hold harmless Rent And Roll LLC from claims, damages, losses, costs, or expenses arising from the customer's negligence, misuse of equipment, failure to supervise participants, violation of safety rules, or breach of the rental agreement.
Medical Treatment
If an injury occurs, the customer is responsible for contacting emergency services or obtaining appropriate medical treatment. Rent And Roll LLC does not provide medical supervision and is not responsible for determining whether a participant is physically able to safely use rental equipment.
Acceptance of Terms
By completing a reservation, signing a rental agreement, accepting delivery, taking possession of equipment, or allowing rental equipment to be used, the customer confirms that they have read, understood, and agreed to this Damage Waiver, Liability Waiver, and Assumption of Risk.
The customer understands that the Damage Waiver provides limited protection only and does not release the customer from responsibility for loss, theft, negligence, misuse, prohibited activities, or damage excluded under these terms. The customer accepts responsibility for the safe use and supervision of all rented equipment throughout the rental period.
